If there are any extenuating circumstances and you cannot pay your debts, we can assist in gaining you relief from some or all of your debts. Declaring chapter 7 bankruptcy allows for you to receive a court order that can release you from responsibility of repaying all your debts. You will be permitted to keep key assets that are considered “exempt property” and your “non-exempt property” will be sold to pay off your debt. You will have the ability to choose either Michigan or Federal exemption depending on which allows you to keep more possessions.
Chapter 13 bankruptcy, which makes up roughly 30 percent of non-business bankruptcy filings, involves repaying some of your debts in order to have the rest forgiven. This is a good option for people who have non-exempt property or cannot file for chapter 7 because their income is too high or they need more time to catch up on mortgage payments.
With chapter 13 bankruptcy, you will have a three-to-five-year repayment plan put into place to repay your creditors.
